The Data Controller is Econet Wireless Zimbabwe, which has its registered office at No. 2 Old Mutare Road, Msasa, Harare, Zimbabwe. Econet Wireless Zimbabwe has appointed a Data Protection Officer for the exercise of the rights indicated below. Users who wish to do so may contact the Data Protection Officer via the certified email address matilda.nengare@econet.co.zw or by registered letter with return receipt sent to No. 2 Old Mutare Road, Msasa, Harare, Zimbabwe.

The Data Processor is Babylon Cloud S.p.A. which has its registered office in Rome, Via di Tor Pagnotta, 86, 00143. Babylon Cloud has a Data Protection Officer for the exercise of the rights indicated below. If all users deem it useful can reach via the certified email address babyloncloud@legalmail.it  or also through the email address dpo@babyloncloud.com  or by registered letter with return receipt to Via di Tor Pagnotta, 86, 00143 in Rome.

  1. CONFIDENTIALITY OF PERSONAL DATA – The data communicated by the Customer during the duration of the contractual relationship are processed pursuant to and for the purposes of art. 13 of Legislative Decree no. 196/2003, containing the Personal Data Protection Code and European Regulation no. 679/2016 (GDPR).
  2. CATEGORIES OF DATA PROCESSED – The data collected by Babylon Cloud include contact details (email/telephone number), billing data and all documents uploaded by the users themselves on the Babylon Cloud technological platform.
  3. PURPOSE OF THE PROCESSING – The data collected by Babylon Cloud are processed only for the purpose of:

3.a. purposes strictly functional to the establishment/management of the contract (and in particular the activation and correct activation of the service, the provision of assistance, the management of the contractual relationship, the monitoring of consumption and traffic also aimed at maintaining the correct level of IT security and fraud prevention);

3.b. purposes related to the fulfilment of legal obligations, regulations, community legislation, provisions issued by public authorities.

  1. COMMUNICATIONS TO THIRD PARTIES – The data collected by Babylon Cloud may be communicated to third parties exclusively for the purposes of carrying out the activities inherent to the contract. The third parties to whom the collected data may be communicated are: Public Administrations, Judicial Authorities, Financial Administrations (fulfilment of legal obligations, regulations, standards, provisions); banks (management of collections and payments).
  2. FAILURE TO CONSENT TO DATA PROCESSING – The processing of data by Babylon Cloud occurs on the basis of the explicit consent of the user. In the event of failure to consent to data processing, Babylon Cloud will not be able to provide its services.
  3. METHODS OF DATA PROCESSING – The data subject to processing is processed using paper, telematic, electronic, computerised or otherwise automated media. Data are stored and processed exclusively in EU countries under GDPR jurisdiction. The data are processed using processes, procedures and technical security measures in order to preserve their confidentiality, integrity and availability. The billing details and all documents uploaded by users to the Babylon Cloud technological platform are stored exclusively for the contractual duration of the services and for a security period (“grace period”) at the end of the service within which the user has the right to recover their data. Contact data are stored until they are necessary with respect to the legitimate purposes for which they were collected, unless the user explicitly expresses their will to remove them.
  4. RIGHTS OF THE INTERESTED PARTY – The interested party to the data processing can exercise the following rights:

– right to obtain information on which data are processed by the owner (right to information);

– right to request and obtain in an intelligible form the data held by the owner (right of access);

– right to withdraw consent at any time;

– exercise opposition to the processing in whole or in part;

– to oppose automated processing;

– right to obtain the deletion of data held by the owner;

– right to obtain the updating or rectification of the data provided;

– right to request and obtain transformation into anonymous form of data;

– right to request and obtain the blocking or limitation of data processed in violation of the law and those whose retention is no longer necessary in relation to the purposes of the processing;

– right to data portability.

8 OPPOSITION TO PROCESSING – The user may, for reasons related to his/her particular situation, oppose the processing of his/her personal data if based on a legitimate interest or, if it occurs, for commercial promotion activities, by sending the request to the Data Protection Officer, at the PEC e-mail address babyloncloud@legalmail.it or by registered mail with return receipt sent to Via di Tor Pagnotta, 86, 00143, Rome.

9 COMPLAINTS BY THE INTERESTED PARTY – The interested party may submit a complaint to the competent supervisory authority in Italy by contacting the Privacy Guarantor (art. 77 of the Regulation), Piazza Venezia 11, 00187 ROME (www.garanteprivacy.it) or by taking legal action (art. 79 of the Regulation).

10 COOKIE POLICY – Cookies are small text strings that the sites visited by the user send to his/her navigation software (Browser), from which they are stored, to then be re-transmitted to the same sites during the same visit or in a subsequent visit by the same user. The Babylon Cloud portal uses cookies exclusively for the purpose of optimizing navigation (technical cookies); failure to consent to the use of cookies prevents access to the Babylon Cloud portal. In any case, the user may at any time manage, or request the general deactivation or deletion of cookies, by changing the settings of his/her internet browser. Such deactivation may affect the correct functioning of the portal.
